Das Unternehmen kann gegen den Bußgeldbescheid Einspruch einlegen.
Aktualisierung:
Der Bußgeldbescheid ist rechtskräftig. - Die Bundesanstalt für Finanzdienstleistungsaufsicht (BaFin) hat am 14. Juni 2023 gegenüber der UmweltBank AG angeordnet, eine ordnungsgemäße Geschäftsorganisation nach § 25a Absatz 2 Satz 2 Kreditwesengesetz (KWG) sicherzustellen. Diese Anordnung hat die BaFin bereits am 1. August 2023 auf ihrer Website veröffentlicht. Des Weiteren hat die BaFin nunmehr mit Bescheid vom 26. Februar 2024 angeordnet, dass gemäß § 6 Absatz 2 Satz 1 und 2 Wertpapierhandelsgesetz (WpHG) das Institut unverzüglich Vorkehrungen und Maßnahmen trifft, um die Einhaltung der nachfolgenden Vorschriften des 11. Abschnitts des WpHG herzustellen und fortlaufend sicherzustellen: § 63 Absatz 6 WpHG in Verbindung mit Artikel 44 der Delegierten Verordnung (EU) 2017/565 (DelVO), § 70 Absatz 1 Satz 2 WpHG, § 80 Absatz 1 Satz 1 und Satz 3 in Verbindung mit den Bestimmungen zur Organisation der Wertpapierdienstleistungsunternehmen in den Artikeln 22, 24 und 26 der Delegierten Verordnung (EU) 2017/565 (DelVO), § 80 Absatz 1 Satz 2 Nr. 1 und 4 WpHG.
Um die Umsetzung der angeordneten Maßnahmen zu überwachen, hat die BaFin am 26. Februar 2024 einen Sonderbeauftragten gemäß § 45c Absatz 1 in Verbindung mit Absatz 2 KWG bestellt.
